These Terms of Service apply to purchases made through the Hung Up Australia online store.
By accessing our website or placing an order, you agree to these terms.
PRODUCTS
Hung Up Australia designs and manufactures customisable equestrian storage products.
Our products are made to order based on the colour, design and cradle finish selected by the customer.
We make every reasonable effort to display our products accurately. Actual colours may vary slightly due to screen settings, lighting, photography and natural differences between manufacturing batches.
PRICES AND PAYMENT
All prices are displayed in Australian dollars.
Applicable product prices, shipping charges and the total order amount are displayed at checkout before payment is completed.
Payment must be received before production begins.
PRE-ORDERS
Pre-order products are not ready for immediate dispatch.
Our current estimated pre-order dispatch timeframe is 2 to 3 weeks from the date the order is placed. This is an estimate rather than a guaranteed dispatch date.
We will contact affected customers if a significant production delay occurs.
ORDER ACCEPTANCE
We reserve the right to cancel or decline an order where:
• Payment cannot be processed
• Product information or pricing contains an obvious error
• Materials required to complete the order become unavailable
• We reasonably suspect fraudulent or unauthorised activity
If we cancel an order after payment has been received, the affected amount will be refunded.
CUSTOM SELECTIONS
Customers are responsible for checking their colour, design, cradle finish, quantity and delivery information before submitting an order.
Requests to change or cancel an order should be sent to hello@hungupaustralia.com as soon as possible. Changes or cancellations cannot be guaranteed after production has begun.
PRODUCT USE
Customers are responsible for installing and using products appropriately and in accordance with any instructions supplied.
Products should be inspected before use. Do not use a product that appears damaged, compromised or unsuitable for its intended mounting surface.
INTELLECTUAL PROPERTY
All Hung Up Australia product designs, branding, logos, photographs, written content and website materials remain the property of Hung Up Australia unless otherwise stated.
They must not be copied, reproduced, manufactured, distributed or used commercially without prior written permission.
AUSTRALIAN CONSUMER LAW
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
LIABILITY
To the extent permitted by law, Hung Up Australia is not responsible for loss or damage resulting from misuse, incorrect installation, unauthorised modification, unsuitable mounting surfaces or use outside the product’s intended purpose.
GOVERNING LAW
These terms are governed by the laws of Victoria, Australia.
